L-160 and L-177 BAfgo).In Art. L 68 1/1 BAfgo (compare also Art. 216), it is stated that no specific right is established in order to enable persons who are not members of an officially recognised trade union to participate in the training service as employees or apprentices, but only on an individual as well as a group basis.1.50 Organisations representing persons who have no right to be members of a trade union must be able to communicate with the authorities on the subject of employment law in order to make representations and give information to the competent authorities, particularly those concerning the rights and obligations of workers in relation to social security. The Conference is aware that organisations representing persons who are not members of an officially recognised trade union are unable to obtain information about their membership status from the relevant workers’ register, and are thus unable to have access to the essential information required for their members. Consequently, the Conference considers that any decision by an employer or an agency concerned about the status of a worker, which does not take into account information supplied on this form, is contrary to Article 2(4) of Directive 98/25/EC .
